SaaS Pegasus Terms of Service and Privacy Policy

Terms Of Service

This license is a legal agreement between you and Elodin Labs LLC for the use of SaaS Pegasus Software (the “Software”). By downloading any SaaS Pegasus files, add-ons, or resources, you agree to be bound by the terms and conditions of this license. Elodin Labs LLC reserves the right to alter this agreement at any time, for any reason, without notice.

License Types

All licenses are governed by these terms.

Single-site versus multi-site

A single-site license (Starter or Professional) grants the right to use the Software on one production and unlimited development sites. Each additional production site using the Software requires an additional purchased single-site license.

An unlimited license grants the right to use the Software on unlimited production sites.

Restrictions

Unless you have been granted prior, written consent from Elodin Labs LLC, you may not:

The above restrictions apply primarily to the use of the software for the purposes of offering a competing product to SaaS Pegasus. In cases where you seek to transfer or sell your Software product as an independent asset consent will be readily granted.

All copyright and proprietary notices and logos within the Software files must remain intact.

Making Copies

You may make copies of the Software for back-up purposes, provided that you reproduce the Software in its original form and with all proprietary notices on the back-up copy.

Software Modification

You may alter, modify, or extend the Software for your own use, or commission a third-party to perform modifications for you, but you may not resell, redistribute or transfer the modified or derivative version without prior written consent from Elodin Labs LLC. Components from the Software may not be extracted and used in other programs without prior written consent from Elodin Labs LLC.

Technical Support

Elodin Labs LLC does not provide direct phone support at this time. No representations or guarantees are made regarding the response time in which e-mail support questions are answered, but we will do our best to respond quickly.

Refunds

Elodin Labs LLC offers limited refunds on software within 7 days of purchase. Contact [email protected] for assistance.

Indemnity

You agree to indemnify and hold harmless Elodin Labs LLC for any third-party claims, actions or suits, as well as any related expenses, liabilities, damages, settlements or fees arising from your use or misuse of the Software, or a violation of any terms of this license.

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, Elodin Labs LLC DOES NOT WARRANT THAT THE SOFTWARE OR ANY RELATED SERVICE WILL ALWAYS BE AVAILABLE.

Limitations Of Liability

YOU ASSUME ALL RISK ASSOCIATED WITH THE INSTALLATION AND USE OF THE SOFTWARE. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS OF THE SOFTWARE BE LIABLE FOR CLAIMS, DAMAGES OR OTHER LIABILITY ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE. LICENSE HOLDERS ARE SOLELY RESPONSIBLE FOR DETERMINING THE APPROPRIATENESS OF USE AND ASSUME ALL RISKS ASSOCIATED WITH ITS USE, INCLUDING BUT NOT LIMITED TO THE RISKS OF PROGRAM ERRORS, DAMAGE TO EQUIPMENT, LOSS OF DATA OR SOFTWARE PROGRAMS, OR UNAVAILABILITY OR INTERRUPTION OF OPERATIONS.

It is SaaS Pegasus’s policy to respect your privacy regarding any information we may collect while operating our website. Accordingly, we have developed this privacy policy in order for you to understand how we collect, use, communicate, disclose and otherwise make use of personal information. We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained. Elodin Labs may change this privacy policy from time to time at our discretion and will change the date above whenever that happens.

Additionally, we collect anonymous analytics data in Google Analytics that is used to monitor and improve the product, which may include the use of cookies.

We do not give or sell your personal information to anyone else. Period.

Information Sharing

We will never share your name or email address without your consent.

We reserve the right to share the domain portion only of your email address under certain circumstances without formal consent. For example, in marketing materials or private messages referencing a list of companies who are customers. We will remove company names from any public materials on request.

Third parties

We send (non-personal) information to Google, for analytics data.

Payments are handled through Stripe, which may access your credit card number. Credit cards are not ever seen or processed by our server.
